Legal Aid Criminal changes

CDS7 Undesignated facility created for claiming Travel & Waiting on PROG claim

A new Designated (CDS7) flag tickbox, has been introduced on the Criminal Billing screen, which defaults to ticked Designated, however should the ‘PROG’ claim need to be undesignated then untick the box, to enable travel and waiting to be claimed, in addition to the standard fee, as per LSC rules.

The CDS7 form template has been modified to show details of this on the ‘extra’ backpage summary information and altered so that it reflects what has been billed. And a footnote has been added to explain this. Also on Page 1 Summary of Claim the Travel and Waiting values (recorded if designated and actual if undesignated) now include VAT as required by LSC.

LSC wording in relation to this:

10.81 Standard Crime Contract 2010 states “Travel and waiting time cannot be claimed separately if you undertake a Case in a Designated Area, or if your Office is in a Designated Area”.

Therefore, if the firm or where the court is in a Designated Area (PROM) the solicitors will not get paid the travel and waiting but record it on page 1 of the CDS7 (inclusive of VAT). They are able to claim and paid the disbursement element of their travel.

Revised Standard Fees and Revised Non-Standard Fees shall apply to those Cases where the Representation Order is granted on or after 16 April 2007.

If the solicitors and court are based outside of the Designated Area (PROG), then they can claim and be paid for travel and waiting together with the disbursement element.

A ‘PROG’ claim is where a firm is always non-designated so can claim the travel and waiting, however if the firm is non-designated but the court they’re working in is in a designated area then they can’t be paid the travel and waiting costs.

Crown Court work

The Crown Court Form 5144 is still used to claim litigator’s payments in confiscation proceedings from the National Taxing Team (NTT) but as from 14/1/2008 the Crown Court Standard Fee Form (5144A) for Lower and Higher Fee work is no longer used. So all cases from 14/1/2008 will produce non-standard, claim as worked, bill and enable the Crown Court Fee Form Report (5144 with yellow corner) to be produced.

Fee Earner Grade Records

The Code for Grade has been extended to allow alphas so rather than just 1-9 the code now accepts A-Z too. These can be referred to within Activity Structure. See Fee Earner Grade Record for details.

Millennium Enhancements

Undertakings processing has been enhanced in order to accommodate Republic Of Ireland requirements; new fields have been added for extra information to be stored, and for later reporting (see below). These are on the Matter details screen.

Reporting:

Undertaking Report (ROI) - a new has been report created to include information, selections and sorts as required.

VAT Return: this has been enhanced to take account of the ‘Percentage deductible’ field on Setup of a VAT Rate, such that the full amount of VAT is NOT reclaimed should there be a value less than 100% in this field.

Legal Aid Criminal information

For time recording specifically for Representation in the magistrates’ court relating to LSC Paragraphs 10.35 to 10.113 of the Specification USE OUTSIDE LONDON rates in ALL cases, as London rates are no longer applicable as from October 2011 (i.e. LSC ‘All Areas’ values are those for Outside London).

Legal Aid changes for February 2012

Note: Some of the following information has been supplied by the LSC and is accurate at the time of inclusion. Please refer to the LSC website for the most up to date information.

Millennium general changes:

There are new LSC lower fees for all aspects of Family PFLRS (Private Law Representation fees) and FAS (Family Advocacy Scheme) which are effective for matters with legal aid granted (certificate applied for) date on or after 1st February 2012. Ensure the matter legal aid granted date is set correctly (change effective for 1st February 2012) for the applicable rate: manually input as the system default is empty or 0. Some examples of the rate changes are shown below but please refer to LSC documentation for full list of fees.

Note: The Level 1: Legal Help Initial advice (standard fee) has been reduced to £86 (from £96)
and the Legal Help – Divorce Petition Only (higher fee) has been reduced to £146 (from £162) as from 1st February 2012.

The Level 2 Legal Help - Children and Finance (processing case/stage level with prefix ‘FPL’) rates have all been reduced as from 1st February 2012.

Note: The Levels 3 & 4, also referred to as the ‘LSC table 7b’ & ‘7c’ values already had their new lower rates set up (October 2011), when instructions were given to apply the uplift (of 10%) to regain pre-feb 2012 rates.

Note: The ‘FPC’ prefix case/stage level fees have been reduced to FPC01 = £132 (from 147) & FPC02 =£365 (from £405) and their total FPC03 = $497 (from £552).

Effective 1st February 2012: For Private Law Family Help, Controlled Work Hourly rate relating to Employment then use the appropriate Activity entry Table 7b, formerly for just titled Family and Housing, check the hourly rates are as expected:-

e.g.

for Preparation, Attendance and Advocacy London rate = £48.74 (was £54.15) and non-london rate is £45.95 (was £51.05)

for Travel & Waiting Time London rate = £25.74 (was £28.60) and non-london rate is £25.74 (was £28.60)

for Routine Letters out and telephone calls London rate = £3.78 (was £4.20) and non-london rate is £3.65 (was £4.05).

The Standard Civil Contract (Family and Housing) is scheduled to come into force in 01/02/2012 so the format of the Reference number will change.

The Submission Reference will be a combination of their “Office Account number” and “/CIVIL”, therefore adopting the format: NANNNA/CIVIL eg 1A123A/CIVIL.

There will be no validation in Millennium except the LSCBulkload report will warn if ‘CIVIL’ does not appear in the global/branch schedule reference in case it has not been updated.

When creating a Civil type Matter the manual input of a schedule reference number is required by the LSC: it should be made up of the global/branch schedule reference and the selected case type and the accounting year in the format specified:-

schedule reference will be in one of 2 formats presently made up of the following components:

“Office Account Number”/”SCC”/”Year” in the format: NANNNA/SCC/NN with LSC Example:

1A123A/SCC/13 or “Office Account Number”/”FAM”/”Year” in the format:NANNNA/FAM/NN with LSC Example: 1A123A/FAM/13 for Family and Housing types which include categories: Family, Housing, Community Care, Consumer General Contract, Debt, Employment, Personal Injury, Welfare benefits or Miscellaneous (Residual list).Please also check LSC Guidance with respect to Tolerance indicator here.

Note: an Information message appears if this field is empty as it may mean the LSC REJECT the bulkload file completely.

When Posting a Bill the schedule reference number appears on the Civil Claim ‘page’ and can be amended for this bill - note a change here does NOT change the matter’s schedule reference number.

There is a new facility to enable Civil billing without VAT being added to the fees/costs in order to calculate the bill total.

This is for use where Legal Aid work is performed for clients who are non resident in the EU. (see section 4.23 of LSC Cost Assessment Guidance June 2001 document).

The example quoted was for use in a claim where a non EU resident is in receipt of Nass Support i.e. a CommunityCare matter with outcome code CNAS. In order to cater for this, a non-VATable tickbox option has been added to the Setup for Matter Type (within Client, Matter, Individual Type) of a new VAT rate shown beside the fees that are, in this case, to be input
as values with no added VAT. So create a new Matter Type, with the Exempt from Vat box ticked, for use in this type of case in order for the resulting FEE on bills to be net of VAT.

This Matter Type tickbox information gets used it the Civil Legal Aid Bill Posting so that VAT does NOT get added to the bill total ie its value matches the fee values etc without adding the standard VAT on top.

Note: The Vat code is set to ‘EX’ for exempt (or ‘04′ for zero in ROI) from VAT and, if matter type option to show on VAT return is requested/ticked, this will then show in the correct place on the VAT Return report.

Note: ensure any disbursements and miscellaneous charges to be included in the bill, have also been set to ‘No VAT’ if the whole bill is to be non-VATable.

Note: The claim VAT may need to be cleared i.e where Profit Costs includes time that has had VAT added to it as ONLY the Fixed or Tolerance FEE itself is affected by the exempt from VAT.

Reporting:

Bulkload Report has been enhanced to contain the new Civil schedule reference field required by the LSC.This appears in the CMSF (new matters starts) and CMRF (consolidated matters) sections of the report and file created for the monthly submission to the LSC which take effect on 1st February 2012.

Christmas 2011 Support Cover

Christmas scene

LEGAL AID CHANGES FOR OCTOBER 2011

Note: Some of the following information has been supplied by the LSC and is accurate at the time of inclusion. Please refer to the LSC website for the most up to date information.

LSC Online

These changes will be introduced into CWA for the 1st of November 2011. The first submission to be affected by the changes will be the October submission (covering cases closed up to the end of October) which is made in CWA from the 1st to the 20th of November. Please note that some changes will be triggered and controlled by case start date so even though the changes will be implemented into the system from the 1st of November cases may not be affected by the new rules until a later date.

Millennium general changes:

New Activity Structure (v12) - to take into account the new (lower) hourly rates involved in Legal Aid work especially Family Advocacy Scheme (FAS), see below.
Please check and make any necessary additions/changes you require (i.e. any that may have been added to v11) BEFORE upgrading to v12.

Reporting

CLS Claim 1 Form report - to cater for changes made by the LSC for October 2011 (version 14): this includes clause text changes on pages 1 and 2, and a new ‘grand total’ value (net + VAT) in the ‘Your Claim and VAT’ section on page 7, for more information see CLS Claim 1 Form in the Millennium product help.
Note: Time entries need to have an Activity Detail Code selected in order for the entries to appear on the Report/CLS Claim 1 Form Schedule of Time Spent section.

Bulkload Report has been enhanced to contain the new Criminal fields required by the LSC - see below for details.

The list of LSC Expert Types has been enhanced, see Bill Posting - Bill Disbursements in the Millennium product help for details.

Civil and Criminal matters

LSC: The key reporting changes being introduced for October 2011 for submissions starting on 1st to 20th November 2011 are as follows:

(note: those items listed below marked with * is where Millennium Accounts has not been changed but the LSC validation has changed)

  • There is a new entry in the Activities Structure/Chart of Accounts, Normal v12, to take into account the new, reduced, LSC rates applicable from 3/10/2011. Please ensure manual changes are made here to match any/all entries being used in Normal v11.
  • Civil Fees are being reduced by 10% as from 3rd October 2011, but the fee schemes are unchanged and the exceptional thresholds remains at 3 times the fee.
  • Magistrates’ court fees will no longer be eligible for London / Non-London rates i.e. for cases where the Magistrates Representation Order Date is >= 3/10/2011.Input of a Representation Order Date with date on or after 3rd October 2011 means the appropriate Magistrates Category selection will be the from the post-LAR (Legal Aid Reform:LSC term) eg ‘Rural cat 1 LSF (summary Only)’ or ‘Urban cat 1 LSF (Either Way)’ or Urban cat 3 HSF’ etc, the fee has been appended to the text shown in order to aid selection. These apply to Non-Designated Fee types PROE, PROF and PROJ and Designated Fee types PROK and PROL claims.Claims with no Representation Order Date or with a date prior to 3rd October 2011 means that the relevant categories from pre-LAR (existing) price list will be offered for selection i.e. eg ‘Rural cat 1 LSF’ or ‘Urban cat 2 LSF’ or ‘London cat 3 HSF’ etc.The Representation Order Date and its associated Standard Fee Category will be added to the Bulkload November 2011 onwards submissions - see below for details.
  • Housing Scheme outcome codes HPPO, HPCO and HPWA attract fees of £75.60 for London and £71.55 for non-London Courts from 3rd October 2011 (i.e lower values).
  • Crime Lower - Associated CLS work claims – As from 3rd October 2011 reduced fees are claimable for codes: ASMS and ASPL. These have Fixed Fees and fixed Exceptional Thresholds applicable at the work started date (or open date if no work started date present):ASMS: if after 1/7/2008 the Fee is £88 and the Exceptional threshold is £264.
    OR if after 1/10/2007 the Fee is £86 and the Exceptional threshold is £258.
    OR if after 3/10/2011 the Fee is £79 and the Exceptional threshold is £237.

    ASPL: if after 1/7/2008 the Fee is £288 and the Exceptional threshold is £864.
    OR if after 1/10/2007 the Fee is £282 and the Exceptional threshold is £846.
    OR if after 3/10/2011 the Fee is £259 and the Exceptional threshold is £777.

  • Procurement Area/Access Point changes include new codes:
    Unified Tolerance ‘PA10001′ and ‘AP10001′ for HOUsing, DEBt, WELfare, COMmunity care, EMPloyment, PERsonal ijury and ConsumerGeneralContract and MIScellaneous
    need to be selected although they will be counted as ‘PA00001′ for the purposes of the Consolidated New Matter Starts reporting. See Civil Bill Posting for details.
    For the TFF Fee Scheme, providers with 2010 Standard Civil Contracts (for HOUsing) will NEED to use Unified Contract ‘PA10000′ and Unified Contract ‘AP10000′ so that the original fee can be claimed, rather than the lower one effective from 3rd October 2011.
    NOTE: New lower fees for all other TFF work apply from 3rd October 2011.
  • New fields are being introduced for October 2011 submissions (completed in CWA on or before 20th November 2011) to the LSC Bulk load report:
    Criminal: Representation Order Date, Standard Fee Category.
